The Deputy Prime Minister, Le Minh Khai, has signed Decision No. 13/2023/QD-TTg, which authorizes the importation of scrap materials as raw materials for production from foreign countries.
Please be informed that the following scrap materials are permitted for import as raw materials for production, as outlined in the recent decision (No. 13/2023/QD-TTg) signed by Deputy Prime Minister Le Minh Khai: Scrap iron, steel, and cast iron; Scrap and fragments of plastic; Scrap paper; Scrap glass; Colored metal scrap
The approved categories of scrap iron, steel, and cast iron for import as raw materials for production are as follows, along with their corresponding Harmonized System (HS) codes:
Scrap and fragments of cast iron (HS code 7204 10 00); Scrap and fragments of alloy steel: Stainless steel (HS code 7204 21 00); Scrap and fragments of alloy steel: Other types (HS code 7204 29 00); Scrap and fragments of tin-plated iron or steel (HS code 7204 30 00); Other scrap and fragments: Turnings, shavings, broken pieces, sawdust, grinding dust, cuttings, and clippings, whether agglomerated or packaged in blocks or bundles (HS code 7204 41 00); Other scrap and fragments: Other types (HS code 7204 49 00).
The permitted scrap and fragments of plastic for import as raw materials for production include: Cellular, non-rigid forms from polymers of ethylene (HS code 3915 10 10); other types from polymers of ethylene (HS code 3915 10 90); other types from polymers of styrene, such as polystyrene (PS), Acrylonitrile Butadiene Styrene (ABS), High Impact Polystyrene (HIPS), and Expanded Polystyrene (EPS) (HS code 3915 20 90); and more.
Scrap paper consists of the following categories: unbleached kraft paper or kraftboard or corrugated paper or corrugated board (HS code 4707 10 00); other paper or paperboard mainly made from mechanically obtained pulp, in rolls or sheets, such as newsprint, magazines, and similar printed matter (HS code 4707 30 00).
Organizations and individuals directly importing scrap materials as raw materials for production are only allowed to import such scrap materials for their own facilities according to the designed capacity to produce goods and commodities.
In terms of transit provisions, it is allowed to import scrap paper with HS code 4707 90 00 from foreign countries, but only if you have obtained an environmental component license. This license, known as the Certificate confirming compliance with environmental protection requirements for importing scrap materials as raw materials for production, must be issued by competent authorities before June 1, 2023. Once you have the license, you can continue to import the scrap paper until the expiration date stated on the license.
Importing scrap and fragments of plastic with HS code 3915 90 00 from foreign countries is permitted, but you need to have either an environmental component license or an environmental license. These licenses must be issued by competent authorities before June 1, 2023. Once you obtain the license, you can continue to import the plastic scrap and fragments until the expiration date specified on the environmental component license or the environmental license. The specific HS code eligible for import as raw materials for production will be mentioned in the issued list of permitted scrap materials.
Importing other types of scrap materials from foreign countries is allowed if you have either an environmental component license or an environmental license. These licenses must be issued by competent authorities before June 1, 2023. The permitted scrap materials may have different names, but they must have the same HS codes as specified in this Decision. You can continue to import these materials until the expiration date stated on the environmental component license or the environmental license.
This Decision will be effective starting from June 1, 2023, and it will replace Decision No. 28/2020/QD-TTg, which was issued by the Prime Minister on September 24, 2020. The purpose of this Decision is to provide an updated list of scrap materials that are permitted for import as raw materials for production from foreign countries.
Beginning June 1, 2023, the import of small particle slag, also known as sand slag, from the iron or steel refining industries (HS code 2618 00 00) for cement production will be conducted in accordance with the regulations specified in the product law for construction materials.
